Does marriage equality help Illinois LGBT adoption?

Illinois gay couples often suffer prejudice and discrimination not only from society or their own families, but also from various institutions and agencies. In many cases, gay couples are up against many more obstacles than their heterosexual counterparts when it comes to the adoption process. Illinois, however, does allow same-sex couples who are in a committed relationship to adopt minor children as a couple and as individuals.

Nonetheless, in many cases, adopted children suffer from psychological issues relating to abandonment and feeling unwanted. The recent Supreme Court decision, which makes gay marriages legal across the United States, can help establish a sense of stability for families that feel as though they have been treated differently than other families who are legally married.

Even though lesbian, gay, bisexual and transgender (LGBT) communities have been allowed to adopt children and become foster parents, there is no specific legislation under Illinois laws to protect the LGBT community against discrimination as they are going through the adoption procedure. As a result, many gay couples feel that it is necessary to consult an attorney to guide them through the legal process.

There have been various studies conducted by the American Academy of Pediatrics, American Academy of Child and Adolescent Psychiatry, American Medical Association and American Medical Association, as well as other organizations. These organizations determined that gay couples can care for children as well as other couples. Therefore, displaying any behavior of prejudice against a LGBT couple is uninformed and likely illegal, according to Illinois state laws.

Furthermore, the problem of abandoned or orphaned children in America in the foster care system is a huge problem. Over 400,000 children are in the U.S. foster care system. Many studies have showed that if such children turn 18-years-old before adoption, the chance of their being able to get a good education and a decent job is significantly reduced. Not allowing people to adopt children simply on the grounds of their sexual orientation is illegal, according to state laws and unethical according to human beings.
